Terms of Service

§ 1 — Definitions

For the purposes of these Terms of Service, the following terms have the meanings set out below:

• "Service" means the MRT Trading Journal web application, including all features, tools, AI coaching functionality, and educational content accessible at mrtjournal.com.
• "Account" means a registered user account created by you to access the Service.
• "User" or "You" means any individual who registers for or uses the Service.
• "Operator" means Mickael Ramy, the individual operating MRT Trading Journal, contactable at legal@mrtjournal.com.
• "User Content" means any data, trades, notes, screenshots, or other information you submit to the Service.
• "Subscription" means a paid plan granting access to additional features of the Service.

§ 2 — Acceptance of Terms

• By creating an Account or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy.
• If you do not agree with any part of these Terms, you must not use the Service.
• You must be at least 18 years of age to use the Service. By using the Service, you confirm you meet this requirement.
• These Terms constitute a legally binding agreement between you and the Operator.

§ 3 — Account Registration

• To access the full functionality of the Service, you must register for an Account by providing a valid email address, your name, and a password.
• You must not create an Account anonymously or using false information. You are solely responsible for the accuracy of all information provided during registration.
• You are responsible for maintaining the confidentiality of your login credentials. You must notify us immediately at hello@mrtjournal.com if you suspect any unauthorised access to your Account.
• You may not create multiple Accounts. Accounts are personal and non-transferable.
• The Operator reserves the right to suspend or terminate any Account that is found to violate these Terms.

§ 4 — The Service

4.1 Description

MRT Trading Journal provides:

• A trade logging tool to record, annotate, and review your trading activity.
• Performance analytics including win rate, profit factor, expectancy, and mistake tracking.
• An AI-powered coaching feature that analyses your trade data and provides personalised feedback.
• A Strategy Builder for documenting and evaluating trading strategies.
• An Education Hub with trading content adapted to your experience level.
• A Calendar and Reviews section for structured performance review.

4.2 No Financial Advice

MRT is not a financial adviser, broker, or any form of regulated financial service. The AI coaching feature and all analytical outputs are for informational and educational purposes only. They do not constitute investment advice, trading recommendations, or any form of financial guidance. You must not rely on any content from the Service as a basis for financial decisions.

4.3 Availability

• We aim to maintain high availability of the Service but do not guarantee uninterrupted access.
• We may perform maintenance, updates, or modifications to the Service at any time. We will endeavour to provide advance notice for planned downtime where possible.
• We are not liable for any losses arising from unavailability of the Service.

§ 5 — Acceptable Use

By using the Service, you agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
• Submit false, misleading, or fraudulent information to the Service.
• Attempt to gain unauthorised access to the Service, other user accounts, or our systems.
• Reverse-engineer, decompile, or attempt to extract the source code of the Service.
• Scrape, harvest, or collect data from the Service at scale by automated means.
• Share your Account credentials with any third party.
• Use the AI Coach feature to generate financial advice for third parties on a commercial basis.
• Transmit any content that is illegal, harmful, threatening, defamatory, or infringes any third-party rights.
• Use the Service in any way that could damage, disable, or impair its performance.

§ 6 — Your Content

• You retain full ownership of all User Content you submit to the Service, including trade data, notes, and screenshots.
• By submitting User Content, you grant the Operator a limited, non-exclusive licence to store, process, and display your content solely for the purpose of providing the Service to you.
• You are solely responsible for the accuracy and legality of your User Content. The Operator does not verify the accuracy of trade data or other information you submit.
• You may export or delete your User Content at any time from the Settings section of the Service.

§ 7 — Subscriptions and Payments

• The Service is currently available free of charge during the beta period. Paid subscription plans may be introduced in the future.
• When paid plans are introduced, you will be notified in advance with clear information about pricing and features before any charge is applied.
• Subscriptions, when introduced, will be billed on a monthly or annual basis in advance. You may cancel at any time; access continues until the end of the current billing period.
• All payment processing will be handled by Stripe, Inc., subject to their Terms of Service.
• The Operator reserves the right to modify pricing with 30 days' notice to existing subscribers. Price changes will not affect ongoing subscription periods already paid for.

§ 8 — Cancellation and Withdrawal

• You may close your Account at any time from the Settings section of the Service.
• Upon closure, all your personal data and User Content will be deleted from our systems within 30 days, in accordance with our Privacy Policy.
• If you are a consumer in the European Union, you have the right to withdraw from any paid contract within 14 days of purchase without giving any reason, except where digital content delivery has already commenced with your express consent prior to the expiry of the withdrawal period. • Where a refund is applicable, it will be processed using the same payment method as the original transaction within 14 days of the withdrawal request.

§ 9 — Limitation of Liability

To the maximum extent permitted by applicable law, the Operator's total liability to you shall not exceed the amount you paid for the Service in the 3 months preceding the claim.

The Operator is not liable for:

• Any trading losses or financial damages — all trading decisions are your own.
• Indirect, incidental, special, or consequential damages.
• Loss of data beyond what can be recovered from our backup systems.
• Unavailability of third-party services including Supabase, Stripe, Anthropic, or Vercel.
• Actions or omissions of third parties.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

§ 10 — Intellectual Property

• The Service, its design, source code, visual assets, and all content created by the Operator (excluding your User Content) are the intellectual property of MRT Trading Journal and are protected by copyright and other applicable laws.
• You may not copy, reproduce, distribute, or create derivative works from the Service or its content without prior written permission.
• The MRT name and logo are the property of the Operator. You may not use them without permission.

§ 11 — Privacy and Data Protection

• The Operator processes your personal data in accordance with the Privacy Policy, which forms an integral part of these Terms.
• By creating an Account, you acknowledge that you have read and understood the Privacy Policy.

§ 12 — Changes to These Terms

• The Operator may update these Terms from time to time. You will be notified by email and via an in-app notification of any material changes.
• Continued use of the Service after 30 days of receiving such notice constitutes acceptance of the updated Terms.
• If you do not accept the updated Terms, you may close your Account before the changes take effect.

§ 13 — Governing Law and Disputes

• These Terms are governed by the laws of the Republic of Poland, without prejudice to any mandatory consumer protection provisions applicable in your country of residence.
• Disputes shall be submitted to the competent courts of Poland, unless applicable law requires otherwise.
• If you are a consumer in the EU, you may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
